It reflects our good-faith intent for how Pourfolio operates, but it is not legal advice and may contain errors or omissions. If you need to rely on these Terms for a specific legal matter, please consult a qualified attorney.
1. Agreement to Terms
By accessing or using Pourfolio (“the Service”), you agree to be bound by these Terms of Service (“Terms”). If you do not agree to these Terms, do not use the Service.
Pourfolio is an independent personal project — not a registered business or commercial entity. It is provided free of charge, as-is, by an individual developer as a passion project for the wine community. There are no paid tiers, no ads, and no commercial obligations.
We may update these Terms from time to time. We will notify you of material changes by posting a notice on the Service. Your continued use after changes constitutes acceptance of the updated Terms.
2. Age Requirement
You must be of legal drinking age in your jurisdiction to use Pourfolio. In the United States, this means you must be at least 21 years old. In the European Union and most other jurisdictions, you must be at least 18 years old.
By creating an account, you confirm that you meet the age requirement. We do not knowingly collect information from anyone under the legal drinking age. If we discover that a user is underage, we will immediately terminate their account and delete all associated data.
3. What Pourfolio Is (and Is Not)
Pourfolio is a wine cellar management and information tool. We help you track your wine collection, manage wine club memberships, conduct guided tastings, discover wineries, and get AI-powered educational information about wine.
Pourfolio does NOT:
- Sell, distribute, or facilitate the sale of alcoholic beverages
- Provide a marketplace for buying or selling wine between users
- Provide health, medical, or nutritional advice
- Guarantee the accuracy of wine aging recommendations, drink windows, or storage advice
- Encourage excessive or irresponsible consumption of alcohol
All information about wine aging, storage temperatures, drink windows, and food pairings is provided for educational and informational purposes only. Wine is a natural product and individual bottles may vary. We are not responsible for wine that has spoiled, deteriorated, or otherwise failed to meet expectations.
4. Your Account
To use certain features of the Service, you must create an account. You are responsible for maintaining the security of your account credentials. You agree to:
- Provide accurate information during registration
- Keep your password secure and confidential
- Notify us immediately of any unauthorized access to your account
- Not share your account with others
We reserve the right to suspend or terminate accounts that violate these Terms or are used for fraudulent purposes.
5. User-Generated Content
You may submit content to the Service, including wine ratings, tasting notes, corrections to wine data, and community contributions ("User Content").
You retain ownership of your User Content. However, by submitting User Content, you grant us a worldwide, non-exclusive, royalty-free license to use, display, and distribute your User Content within the Service for the purpose of operating and improving Pourfolio.
If you delete your account, your personal User Content (ratings, cellar data) will be deleted. Community contributions (wine data corrections) may be retained in anonymized form to maintain data quality for other users.
You agree not to submit content that:
- Is false, misleading, or fraudulent
- Infringes on intellectual property rights of others
- Contains hate speech, harassment, or threats
- Promotes illegal activity
- Contains malware, spam, or unauthorized advertising
Content Moderation: We employ automated filters to block obviously inappropriate content from public-facing features (such as community ratings). Content that violates these guidelines may be automatically rejected or removed without notice.
6. AI-Generated Content
Most reference content displayed in Pourfolio is generated by artificial intelligence. This includes, but is not limited to:
- Wine descriptions, fun facts, and tasting notes
- Drink window estimates and aging guidance
- Grape variety profiles, flavor descriptors, body, tannin, and acidity ratings
- Wine region descriptions, climate notes, and characteristic varietals
- Winery descriptions, signature styles, and fun facts
- Regional grape expression notes (how a grape is expected to taste in a given region)
- Varietal blend percentages where not otherwise documented
- Wine-pairing suggestions and recommendations
- AI Sommelier chat responses
- Verification flags applied to community-submitted wines
This content is generated by large language models (currently OpenAI GPT-4o family) from public data sources. It may be inaccurate, incomplete, outdated, or fabricated. Common error modes include: hallucinated wineries or vintages, incorrect drink windows, misattributed varietal blends, fabricated awards or critic scores, incorrect food pairings, and confidently-stated facts that are simply wrong.
Do not rely on AI-generated content for:
- Purchase decisions, wine valuation, or investment
- Storage temperature, humidity, or aging strategy for valuable bottles
- Decisions on when to open, decant, or serve a specific bottle
- Allergen, ingredient, or dietary information
- Authenticity verification of any wine
- Any decision where accuracy materially matters
For decisions of consequence, consult a qualified sommelier, wine merchant, or other professional. Verify factual claims (vintages, scores, producer information) against authoritative sources.
We do not warrant the accuracy, completeness, currency, or reliability of any AI-generated content. User-submitted content (your bottles, ratings, tasting notes, photos) and core catalog data (wine name, vintage, producer, where sourced from external catalogs) are not AI-generated, but may still contain errors.
You can help improve content quality by reporting errors via the "Report inaccurate information" link on detail pages.
7. Service Availability
Pourfolio is a free personal project. There are no paid tiers, subscriptions, or payment processing. The service is provided as-is with no guarantee of uptime or availability. Features may change at any time.
8. Intellectual Property
The Service, including its design, code, features, and branding (excluding User Content), is owned by Pourfolio and protected by copyright, trademark, and other intellectual property laws.
You may not copy, modify, distribute, sell, or create derivative works based on the Service without our prior written consent.
"Pourfolio" and the Pourfolio logo are trademarks of Pourfolio. You may not use them without permission.
9. Third-Party Services
The Service integrates with third-party services including:
- Supabase — authentication and data storage
- OpenAI — AI-powered features
- Meilisearch — wine search
- Microsoft Azure — application hosting
- Cloudflare — DNS, CDN, and DDoS protection
Your use of these third-party services is subject to their respective terms and privacy policies. We are not responsible for the practices of third-party service providers.
10. Limitation of Liability
TO THE MAXIMUM EXTENT PERMITTED BY LAW, POURFOLIO AND ITS AFFILIATES, OFFICERS, EMPLOYEES, AGENTS, AND LICENSORS SHALL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, INCLUDING BUT NOT LIMITED TO:
- Loss of profits, data, or goodwill
- Wine spoilage or deterioration based on our recommendations
- Inaccurate wine data, aging estimates, or storage advice
- Service interruptions or data loss
- Unauthorized access to your account
OUR TOTAL LIABILITY FOR ANY CLAIMS ARISING FROM YOUR USE OF THE SERVICE SHALL NOT EXCEED THE AMOUNT YOU PAID US IN THE 12 MONTHS PRECEDING THE CLAIM, OR $100, WHICHEVER IS GREATER.
Note for EU users: Nothing in these Terms limits your rights under mandatory EU consumer protection laws, including the Consumer Rights Directive (2011/83/EU).
11. Disclaimer of Warranties
THE SERVICE IS PROVIDED "AS IS" AND "AS AVAILABLE" WITHOUT WARRANTIES OF ANY KIND, EITHER EXPRESS OR IMPLIED, INCLUDING BUT NOT LIMITED TO IMPLIED WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, AND NON-INFRINGEMENT.
We do not warrant that the Service will be uninterrupted, error-free, or free of viruses or other harmful components.
12. Indemnification
You agree to indemnify and hold harmless Pourfolio from any claims, losses, liabilities, damages, costs, and expenses (including reasonable attorneys' fees) arising from your use of the Service, your User Content, or your violation of these Terms.
13. Dispute Resolution
For US users: Any disputes arising from these Terms or your use of the Service shall be resolved through binding arbitration in accordance with the rules of the American Arbitration Association. You agree to waive your right to a jury trial and to participate in class action lawsuits.
30-day arbitration opt-out: You may opt out of the arbitration agreement above by sending written notice to legal@pourfolio.wine within 30 days of first creating your account. Your notice must include your account email (or display name + signup date) and the words "Arbitration Opt-Out." Opting out does not affect any other provision of these Terms.
Venue for non-arbitrable disputes: For any dispute that is not subject to arbitration (including disputes by users who have opted out per the prior paragraph), you and Pourfolio agree that the exclusive venue shall be the state or federal courts located in King County, Washington, United States.
For EU users: You retain your right to bring claims before your local courts in accordance with applicable EU law. You may also use the EU Online Dispute Resolution platform at https://ec.europa.eu/consumers/odr.
14. Governing Law
These Terms shall be governed by the laws of the State of Washington, United States, without regard to conflict of law provisions. For EU users, mandatory local consumer protection laws apply in addition.
15. Termination
You may terminate your account at any time by using the account deletion feature in Settings. We may terminate or suspend your access to the Service at any time for violation of these Terms, with or without notice.
Upon termination, your right to use the Service ceases immediately. We will delete your data in accordance with our Privacy Policy.
16. Responsible Drinking
Pourfolio promotes the enjoyment and appreciation of wine. We encourage all users to drink responsibly and in moderation. If you or someone you know has a problem with alcohol, please contact:

18. General Provisions
Severability: If any provision of these Terms is found to be unenforceable or invalid by a court of competent jurisdiction, the remaining provisions shall continue in full force and effect.
Entire Agreement: These Terms, together with our Privacy Policy, constitute the entire agreement between you and Pourfolio regarding the Service and supersede any prior agreements or understandings.
Assignment: You may not assign or transfer your rights or obligations under these Terms without our prior written consent. We may assign these Terms (in whole or in part) without restriction, including in connection with a merger, acquisition, or sale of assets. Successors in interest are bound by these Terms.
Force Majeure: We are not liable for any failure or delay in performance caused by circumstances beyond our reasonable control, including but not limited to: outages or failures of third-party providers (Supabase, Microsoft Azure, OpenAI, Cloudflare, Meilisearch), internet or telecommunications failures, acts of God, war, civil unrest, government action, or pandemic.
Notices: Legal notices to Pourfolio must be sent to legal@pourfolio.wine. Notices to you may be sent via the email address associated with your account or by posting on the Service. Notices are deemed received when sent.
No Waiver: Our failure to enforce any right or provision of these Terms does not constitute a waiver of that right or provision.
